85-ADM-23 - Implementation of Chapter 872 Laws of 84
This directive advises social services districts and other authorized agencies of recent amendments to Section 358-a of the Social Services Law and Section 1052(b) of the Family Court Act. These amendments require that before a court can approve the placement of a child into foster care pursuant to the above noted sections, it must determine that reasonable efforts were made to prevent the placement of the child into foster care. The directive also advises social services districts and other authorized agencies of the actions which are necessary in order to comply with the reasonable efforts requirements.

The purpose of this Directive is threefold. The first is to advise local districts of an amendment to Section 605.2(c)(4)(iii) of the Department's Regulations effective October 24, 1984. This Regulation deals with reimbursement of expenditures for the care of a child in either direct care provided by the district or care provided through purchase of service contracts when the child is absent due to vacation. Second, it clarifies the proper interpretation of all the reimbusable absences referred in Section 605.2(c)(4). Third, it describes the different application of these regulations between foster care placements and children placed by local education agencies through their Committees on the Handicapped, pursuant to Article 89 of Education Law.

The purpose of this letter is to encourage local social services districts and authorized adoption agencies to make placements of certain foster children who are not likely to return home but who are not yet freed for adoption with foster families who will make a commitment to adopt the child if and when the child is legally freed and to provide foster care for the child as long as the child needs it even if the child is not freed. As there is some risk that the child may not be freed for adoption, these placements are termed "at risk" placements, This letter discusses the nature of such placements and presents guidelines which identify situations and conditions for considering children and families appropriate for an "at risk" placement.

The purpose of this release is to inform social services districts and welfare attorneys of the enactment of Chapter 724 of the Laws of 1985. That Chapter amends Section 1046(a)(vi) of the Family Court Act to provide that a child's testimony in child protective proceedings in Family Court is not necessary as corroboration of the child's out-of-court statements concerning child abuse or neglect. Chapter 724 also specifies that any other evidence tending to establish the reliability of the child's out-of-court statements will be sufficient corroboration of the child's statements to make a fact finding of abuse or neglect.

The purpose of this release is to inform local districts, attorneys and agencies caring for child protective services cases of the provisions of Chapter 232 of the Laws of 1983, which amends Section 1112 of the Family Court Act. This law grants an automatic stay of any order issued pursuant to Article 10 of the Family Court Act which would return a child to his or her parent(s) or guardian if the child had previously been remanded or placed by the court with some other person.

The purpose of this release is to advise social services districts of the decision in Ruiz v. Blum (549 F. Supp. 871; USDC:SDNY). The court in this case held that children are the primary beneficiaries of day care benefits and that a child who is otherwise eligible for day care benefits cannot be denied such benefits because the parents of the child are aliens who are unlawfully residing in the United States or because the parents fail to furnish evidence that they are lawfully residing in the United States. In addition, the release discusses an issue related to the Ruiz decision. The issue concerns the ability of social services districts to require that persons who apply for a social service must disclose their Social Security numbers before such service can be provided. This requirement is contained in 18 NYCRR 404.1(c)(4).

This release also notifies social services districts that the Department has revised the required Notification Letters which inform subjects and other persons named in a report of child abuse or maltreatment of their respective rights.
