The purpose of this release is to explain when and how the Interstate Compact network is to be used for placement of children between states. All staff who provide services to children and families, and their supervisors, should be familiar with the Interstate Compact on the Placem_ent of Children (Section 374-a of the Social Services Law). Every effort should be made to explore the possibility for placement of a child in another state when there is reason to believe that such & placement will be in the child's best interest. Such consideration is appropriate when the service plan for a child is developed or revised. Staff with children's services responsibilities should have a knowledge of the steps which should be followed when there is a possibility of a child being placed in another state. They should have. an understanding of their respective roles both as a sending agency and as a receiving agency. Section IV of this Letter details these functions and may be used as a guide by casework staff. The Interstate Compact staff in the State Department of Social Services are also prepared to respond to specific questions regarding the applicability of the Compact in various circumstances and to assist in obtaining approval for placement from Compact staff of other states. The purpose of this Directive is threefold. The first is to advise local districts of an amendment to Section 605.2(c)(4)(iii) of the Department's Regulations effective October 24, 1984. This Regulation deals with reimbursement of expenditures for the care of a child in either direct care provided by the district or care provided through purchase of service contracts when the child is absent due to vacation. Second, it clarifies the proper interpretation of all the reimbusable absences referred in Section 605.2(c)(4). Third, it describes the different application of these regulations between foster care placements and children placed by local education agencies through their Committees on the Handicapped, pursuant to Article 89 of Education Law.

The purpose of this release is to inform social services districts and welfare attorneys of the enactment of Chapter 724 of the Laws of 1985. That Chapter amends Section 1046(a)(vi) of the Family Court Act to provide that a child's testimony in child protective proceedings in Family Court is not necessary as corroboration of the child's out-of-court statements concerning child abuse or neglect. Chapter 724 also specifies that any other evidence tending to establish the reliability of the child's out-of-court statements will be sufficient corroboration of the child's statements to make a fact finding of abuse or neglect.

This regulation defines reimbursement of expenditures for the care of a child provided by a district directly or through purchase of service contracts in authorized agencies and care provided by approved schools for the handicapped when the child is absent due to hospitalization. The amended regulation provides for additional reimbursable time for hospitalized children who have Acquired Immune Deficiency Syndrome (AIDS), AIDS Related Complex (ARC) or who test positive for HTLV-111 virus.

The purpose of this release is to advise social services districts and child protective services staff of the provisions of Chapter 822 of the Laws of 1984. This chapter amended Sections 412, 422 and 424 of the Social Services Law to distinguish between the persons allegedly responsible for child abuse or maltreatment and other persons named in the report; to delete the authority of the Department to seal child abuse and maltreatment reports; and to establish specific time frames in which requests to amend or expunge child abuse and maltreatment records must be made. This release also notifies social services districts that the Department has revised the required Notification Letters which inform subjects and other persons named in a report of child abuse or maltreatment of their respective rights.
