A REMINDER TO MANDATED REPORTERS

Immediately file a report with the Statewide Central Register of Child Abuse and Maltreatment (SCR) if you:
  1. have reasonable cause to suspect a child coming before you in your professional or official capacity is being abused or maltreated; or
  2. have reasonable cause to suspect that a child is being abused or maltreated where the parent, guardian, custodian or person legally responsible for the child comes to you in your professional or official capacity and states from personal knowledge, facts, conditions or circumstances which, if correct, would render the child abused or maltreated.
  3. Social services workers only: where the social services worker has reasonable cause to suspect that a child is an abused or maltreated child where any person comes before you in your professional or official capacity and states from personal knowledge, facts, conditions or circumstances which, if correct, would render the child abused or maltreated.
  • The penalty for failure to report is a Class A misdemeanor (punishable by up to a year in jail and/or a fine of up to $1,000) and the mandated reporter can also be held civilly liable for the damages proximately caused by the failure to report.
  • The legal obligation to report suspected child abuse and maltreatment rests on the individual mandated reporter.
  • After the report is made to the SCR, a mandated reporter who works in a medical or other public or private institution, school, facility, or agency must inform the organization’s leader and/or a person designated by the organization’s leader for that purpose.
