Intersection of Adult Protective Services and Supported Decision-Making

Administration for Community Living – American Rescue Plan Act Adult Protective Services Grant FFY 22

The purpose of this Local Commissioners Memorandum (LCM) is to advise local departments of social services (LDSSs) of the availability of federal funds through the American Rescue Plan Act of 2021: Grants to Enhance Adult Protective Services administered by the Administration for Community Living (ACL). The federal ACL has made available one-time funding in the amount of $9,195,346 to New York State for use from August 1, 2022, through September 30, 2024. This LCM provides information on each LDSS’s allocation (Attachment A) from the remaining funds, how the funds can be used, and annual reporting and claiming requirements.

Changes in Annual Assessment Requirements for Community Guardianship Programs

The purpose of this Administrative Directive (ADM) is to inform local departments of social services (LDSSs) of Chapter 579 of the Laws of 2019, which amends Social Services Law (SSL) § 473-d by eliminating redundant and unnecessary reporting requirements and reduces the number of required annual assessments for clients of a community guardianship program.

Administration for Community Living - Adult Protective Services Grant

The purpose of this Local Commissioners Memorandum (LCM) is to advise local departments of social services (LDSSs) of the availability of federal funds through the Grants to Enhance Adult Protective Services to Respond to COVID-19 administered by the Administration for Community Living (ACL). The federal ACL has made available one-time funding in the amount of $5,306,382 to New York State for use from April 1, 2021, through May 31, 2022. The New York State Office of Children and Family Services (OCFS) intends to use $480,000 of the federal funding to enhance the Adult Protective Services (APS) database, known as ASAP.Net. This LCM provides information on each LDSS’s allocation (Attachment A) from the remaining funds, how the funds can be used, and annual reporting and claiming requirements.

Dual Certification of Foster Boarding Homes and Family-Type Homes for Adults

The purpose of this Informational Letter (INF) is to make local departments of social services (LDSSs) and voluntary authorized agencies (VAs) aware of the potential for certified or approved foster boarding homes to obtain certification as Family-Type Homes for Adults (FTHAs) to provide continuity of care for a youth in foster care residing in the foster home who is approaching age 21 who lacks the skills or ability to live independently. As used in this INF, the term “dual certification” means the ability of an individual to be both 1. a certified or approved foster parent for youth in foster care through age 21, and 2. a certified FTHA operator for a youth formerly in foster care who is age 21 or older.

SFY 2018-19 Social Services Block Grant (Title XX) Allocations

The purpose of this New York State Office of Children and Family Services (OCFS) Local Commissioners Memorandum (LCM) is to provide local departments of social services (LDSSs) with their Title XX Social Services Block Grant (SSBG) allocations for State Fiscal Year (SFY) 2018-19. This LCM was revised to include Attachment for U.S. Department of Health and Human Services Grants, which must be provided to all subrecipients per Title 45 U.S. Code of Federal Regulations Part 75 (45 CFR 75), Uniform Administrative Requirements, Cost Principles, and Audit Requirements for HHS Awards, section 352.
