A proposed regulation may be filed as a consensus regulation if the agency concludes that the proposed regulation is non-controversial based on its subject matter and its potential effect on regulated parties. The filing package for a consensus regulation does not have to include a Regulatory Impact Statement, Regulatory Flexibility Analysis or Rural Area Flexibility Analysis. However, a Justification for Consensus Rulemaking and Job Impact Statement must be filed with the proposed regulations. The comment period generally is 45 days from the date of publication in the State Register.
