Duties
Review the agency’s Equal Opportunity and Diversity Development Office’s (EODD) written reports of its investigations of internal and external complaints of workplace discrimination, as well as all materials relevant to the complaints, and requesting supplemental investigations when necessary; Analyze legal issues and research relevant legal principles and laws; Prepare written recommendations for discipline of varying complexity; Monitor the progress of protected class matters; Collaborate with the agency’s Labor Relations Department (LR) in determining disciplinary charges, in drafting notices of discipline, and in determining the course of discipline to be taken and the parameters of settlement, if any; Assist LR in prepping for arbitration and, in some instances, by conducting the arbitration in either a first or second chair capacity; For matters involving external complaints of workplace discrimination, represent the agency before the State Division of Human Rights, and any related venues; Assist the Attorney General’s Office with actions before state and federal courts; Perform attendant litigation tasks such as preparing pleadings, compiling discovery, prepping for hearings and trials, negotiating interim matters and final relief with opposing counsel, preparing settlement documents, and conducting hearings and trials; Handle additional general litigation matters involving representation of the agency before various courts and administrative venues; Participate on agency committees related to employment law issues.
Minimum Qualifications
One year of permanent competitive or 55b/c service as a Senior Attorney in a New York State Civil Service position; or one year of permanent competitive service in a title eligible for transfer under Section 52.6 of the Civil Service Law. And_ Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment. Candidates must have 24 months of satisfactory legal experience for appointment to the Senior Attorney position. If you are on the Legal Specialties eligible list, you may receive a canvass letter.
